Principles of data processing

EKRO Bausystem GmbH attaches great importance to the protection of your privacy and your personal data.

In order to fulfil our information obligations pursuant to Art. 12 ff of the General Data Protection Regulation (GDPR), we are pleased to present our information on data protection below.

What personal data is processed by EKRO and for what purpose?

If we have received data from you, we will only process it for the purposes for which we received or collected it.

Data processing for other purposes is only considered if the necessary legal requirements are met in accordance with Art. 6 para. 4 GDPR. Any information obligations pursuant to Art. 13 para. 3 GDPR and Art. 14 para. 4 GDPR will naturally be observed in this case.

Use of the website

The use of this website is generally possible without providing personal data. You are solely responsible for determining whether you wish to provide us with your e-mail address or address in order to be able to contact you, process your request or give you access to special information or offers.  In this respect, we do not collect any personal data on our website without your express and voluntary consent.  If you provide us with personal data, it will be treated strictly confidential and will not be passed on to third parties without your express consent.  All information we receive from you when you use our internet services is used exclusively for the processing of user information and for communication about orders, products and services.

WooCommerce

This website uses the plugin WooCommerce, a shop system of WordPress, a subsidiary of Automattic Inc. (60 29th Street #343, San Francisco, CA 94 110, USA).   WooCommerce is an online shop system designed specifically for WordPress sites.  It is a customizable, open source eCommerce platform based on WordPress and also integrated into our website as a WordPress plugin.

Information that you actively enter in a text field in our online shop can be collected and stored by WooCommerce or Automattic.  Thus, when you register with us or order a product, Automattic can collect, process and store this data.  In addition to your e-mail address, name or address, this may also include credit card or billing information.

Server log files

The provider of the pages automatically collects and stores information in so-called server log files, which your browser automatically transmits to us.

These are:

  • Browser type/ browser version
  • Operating system used
  • Referrer URL
  • Hostname of the accessing computer
  • Time of the server request

These data cannot be assigned to specific persons.  This data will not be merged with other data sources.  We reserve the right to check this data subsequently if we become aware of specific indications of unlawful use.

On what legal basis is the processing described above based?

The legal basis for the processing of personal data is inprinciple – unless specific legislation already exists – Art. 6GDPR . In particular, the following options could be considered:
• Consent (Art. 6 para. 1 lit. a ) GDPR)
• Data processing for the performance of contracts (Art. 6para. 1 lit. b) GDPR
• Data processing on the basis of a balancing of interests (Art. 6 para.1 lit. f) GDPR)
• Data processing for the fulfilment of a legal obligation (Art. 6para. 1 lit. c ) GDPR)

If personal data is processed on the basis of your consent, you have the right to revoke your consent at any time with future effect.

If we process data on the basis of a balancing of interests, you as the data subject have the right to object to the processing of personal data taking into account the provisions of Art. 21 GDPR.

How long will the data be stored?

We process the data for as long as it is necessary for the respective purpose.

Insofar as statutory retention obligations exist – e.g. in company law or tax law – the personal data concerned will be stored for the duration of the retention obligation.  Once the retention obligation has expired, it will be checked whether there is a further need for processing.  If a requirement is no longer present, the data will be deleted.

Of course, you can at any time (see below) request information about the personal data stored by us and, in the event of a non-existent need, request deletion of the data or restriction of processing.

To which recipients are the data passed?

A transfer of your personal data to third parties takes place only if this is necessary for the execution of the contract with you, the transfer on the basis of a balancing of interests in the sense of the term.  Art. 6 para. 1 lit.  f)   GDPR is permissible, we are legally obliged to pass it on or you have given your consent to this.

How does EKRO ensure data security?

We take diligent precautions to protect your data from loss, manipulation and unauthorized access.  The arrangements correspond to the state of technological development and the legal requirements.

How can I assert my right as a “data subject”?

You have the right to information about the personal data weprocess about you.
In the event of a request for information that is not made inwriting, we ask for your understanding that we may then askyou to provide proof that you are the person you claim to be.
Furthermore, you have the right to rectification or deletion orrestriction of processing, to the extent that you are entitled todo so by law.
Furthermore, you have the right to object to processing withinthe scope of the legal requirements. The same applies to aright to data portability.
In particular, you have a right to object pursuant to Art. 21 (1)and (2) GDPR to the processing of your data in connection withdirect advertising, if this is based on a balancing of interests.

You also have the right to complain about our processing ofpersonal data to a data protection supervisory authority.
